LACEY ACT PHASE VII: APHIS DECLARATION IMPLEMENTATION SCHEDULED FOR THIS FALL
APHIS is setting the stage for Phase VII, the latest declaration requirement. In this phase, all remaining plant product Harmonized Tariff Schedule (HTS) codes that are not 100% composite materials will require a Lacey Act declaration. Items that previously were not subject to the Lacey declarations, such as furniture, additional essential oils, and cork will be required. Once the list of affected HTS codes is published in the Federal Register, the declarations for those product codes will be required six months later.
Know your Supply Chain
If you import items that contain plant products and currently do not file a Lacey Act declaration, it is likely that you will need to file one once Phase VII is implemented. You can find the PPQ Form 505 here for compliance with the Lacey Act requirements.
An imported product may include many different plant species. For example, furniture may include inlays of many species. Communicate with your suppliers to obtain plant information, including the scientific name for each piece of plant product and where that plant was harvested.
