Trade Alert: 50% Section 232 Duties on Copper Imports – Effective August 1, 2025

On July 30, 2025, the President issued a Proclamation under Section 232 of the Trade Expansion Act of 1962 (19 U.S.C. 1862), establishing a 50% ad valorem tariff on all imports of semi-finished copper products and intensive copper derivative products from all countries. Key Points:
  • A 50% duty applies to the copper content of all covered imports (HTSUS 9903.78.01).
  • 0% duty applies to non-copper content or goods with no copper (HTSUS 9903.78.02).
  • Applies to all countries.
  • Importers must separately report copper and non-copper values on entry summaries.
  • Documentation (e.g., invoices, bills of materials) must support copper content valuation.
  • No drawback allowed.
  • Goods entering Foreign Trade Zones must be admitted under privileged foreign status.
  • Exemptions:
  • Goods already subject to Section 232 auto parts duties.
  • IEEPA reciprocal tariff exception (HTSUS 9903.01.33).
