Trade Alert: New 25% Duty on Imports from India – Effective August 27, 2025
Issued under Executive Order 14329 – “Addressing Threats to the United States by the Government of the Russian Federation”: Effective August 27, 2025, U.S. Customs and Border Protection (CBP) will impose an additional 25% ad valorem duty on most imports originating from India. This action is in response to India’s continued direct or indirect importation of oil from the Russian Federation.

Products of India are exempt from the 25% duty if they fall under the following HTSUS headings:

Chapter 98 Entries:

Duty Rate & Applicability:
- 25% additional duty under HTSUS heading 9903.01.84
- Applies to all products of India, except:
- Items under HTSUS headings 9903.01.85 – 9903.01.89
- Personal-use items in accompanied baggage
Entry Requirements:
- Applies to goods entered or withdrawn for consumption on or after 12:01 a.m. EDT, August 27, 2025
- Duty is in addition to existing tariffs under EO 14257 and other applicable duties (e.g., AD/CVD)
Exemptions:
Products of India are exempt from the 25% duty if they fall under the following HTSUS headings:
- 9903.01.85 – In-transit goods loaded before August 27 and entered before September 17
- 9903.01.86 – Items listed in Annex II of EO 14257
- 9903.01.87 – Specific industrial and automotive goods already covered under other HTSUS headings
- 9903.01.88 – Humanitarian donations (food, clothing, medicine)
- 9903.01.89 – Informational materials (books, films, CDs, artwork, etc.)
Special Considerations:
Chapter 98 Entries:
- Additional duties do not apply to most Chapter 98 entries, except:
- 9802.00.80 – Duties apply to the value of assembly in India
- 9802.00.40, .50, .60 – Duties apply to the value of repairs/processing in India
- Products of India must be admitted under privileged foreign status if entering FTZs on or after August 27
- Duties will apply upon entry for consumption
- Drawback is available for duties imposed under EO 14329
